1. Welcome to Cocoon&me Terms and Conditions, herein after referred to as Cocoon&me. These terms and conditions apply to the use of www.cocoonandme.com & cocoonandme.co.uk. By accessing this site and/or placing an order you agree to be bound by these terms. Please read these terms and conditions carefully before placing an order.
2. The www.cocoonandme.com website is operated by Cocoon&me.
3. We reserve the right to change these terms and conditions at any time.
4. The content of the website and samples are for your personal use only and you may not download the content (unless indicated), copy, distribute, transmit, reproduce, publish or commercially exploit or create derivative work from the content or samples.
5. Unless otherwise stated the copyright and all other intellectual property rights in all material (including, without limitation, photographs and graphical images) are the property of Cocoon&me.
a. Cocoon&me respects and rigorously abides by intellectual property laws. We are owners or lawful licensees of all design rights and content (including but not limited to designs, logos, colour schemes, graphic styles, text, images and videos) displayed on this website.
b. Any unauthorised copying, publication, reproduction or distribution of copyrighted works is an infringement of the copyright owners' rights and is therefore prohibited.
c. Any unauthorised use of Cocoon&me Company’s trademarks, logos, slogans, screen shots, graphic styles, designs, copyrighted materials or any branded features without the prior written permission of Cocoon&me is strictly prohibited.
d. If you infringe upon Cocoon&me rights with respect to any property, you will be ordered to cease such illegal activity and you will be strictly liable to Cocoon&me for all damages (including recovery of attorneys' fees) which may be suffered and/or incurred because of your infringement.
6. Cocoon&me reserves the right to change the prices of our products. All products are charged at the price shown on the date an order is placed. All our prices are shown in Pounds Sterling.
7. Reproduction of colours and images are as close as possible, but they may vary slightly from the photographs shown. Our sample service and your proof will more accurately reflect your chosen product, although final production may vary slightly.
8. All designs are handmade, so slight variations may occur. All orders are subject to material availability, so should any item be unavailable; we will inform you and propose a similar alternative. We reserve the right to make substitutions to ensure the highest quality possible within the price quoted.
9. If you wish to cancel an order you must notify us in writing immediately, to info@cocoonandme.com. If you have a personalised order no refunds or exchanges will be allowed.
10. Any refunds or exchanges will be at our sole discretion and will only be made if the item is faulty or does not meet the specifications of your order.
11. All Cocoon&me orders will be sent by Royal Mail. Delivery charges will vary depending upon weight, size of your order and delivery service requested. All orders will require a signature. Any dates quoted for delivery are approximate only; we cannot be liable for delays in delivery due to the delivery service, or other circumstances beyond our control. Those items for delivery to countries outside of the European Union ("EU") may be subject to taxes, customs duties and fees levied by the destination country ("Import Fees"). The recipient of the delivery is the importer in the destination country and is responsible for all Import Fees. For each item that incurs Import Fees, you authorise Cocoon & me to designate a carrier ("Designated Carrier") to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise, process and remit your Import Fees for each item. Title and risk of loss for each item will transfer to the recipient upon delivery to the Designated Carrier. In the case of gifts or other purchases made on behalf of another recipient, you also agree to secure and grant the foregoing authorisations on behalf of the recipient designated in your order. To obtain details regarding the Actual Import Fees, or to obtain documentation or receipts in connection with customs clearance, you may contact the Carrier specified on your invoice confirmation e-mail.
12. All orders are carefully packed to avoid damage in delivery, and any damage must therefore be notified immediately on receipt of the goods. Responsibility for damage to or loss of goods shall pass to the customer at the time of accepting delivery.
13. If you feel that there are any discrepancies with your order these must be communicated within 24 hours to us and confirmed in writing within 7 days.
14. In the event of a claim, for defectively produced goods, settlement will be limited to a maximum of the total value of the goods, and Cocoon&me do not accept any liability in respect of any consequential losses howsoever they may be caused.
15. Cocoon&me will not be liable to the customer or be deemed in breach of this agreement by reason of any delay in performing, or any failure to perform any of Cocoon & me’s obligations in relation to the goods, if the delay or failure was due to any cause beyond Cocoon & me's reasonable control. The following shall be regarded as non-exclusive examples of causes beyond Cocoon&me’s reasonable control:
Act of God, flood, explosion, fire or accident.
a. War or threat of war, sabotage, insurrection, civil disturbance or requisition.
b. Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of governmental, parliamentary or local authority
c. Import or export regulations or embargoes
d. Strikes, lock-outs or any other industrial actions or trade disputes (whether involving employees of Cocoon & me or of a third party)
e. Difficulties in obtaining raw materials, labour, fuel, parts or machinery.
f. Power failure or breakdown in machinery.
16. Any dispute claims or proceedings of whatever nature between Cocoon&me and the Customer in connection with or arising out of the validity, construction or performance of this agreement shall be subject to the non-exclusive jurisdiction of The High Court of England and Wales, to which both parties irrevocably submit. The validity, construction and performance of this agreement shall be governed by English Law.
17. We cannot be held responsible for damage which occurs when you post individual items to your guests.
18. Cocoon&me will not share any information that you provide with any third party. The information you pass onto us will enable us to supply the goods or services you have requested. It will also enable us to invoice you and contact you when necessary concerning your orders. We may also use and analyse the information we collect to improve and develop our business. We may be required, and by booking a workshop you permit us, to share your contact details with NHS Test and Trace
19. OPENING AN ACCOUNT AND PLACING AN ORDER
To place an order, you can open an account with us which will require you to provide some compulsory personal information. Alternatively, you can choose to place your order via the guest checkout You confirm that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and at all times. You can update or correct your details at any time by going to Your Account. When you create an account we may provide you with and/or ask you to use passwords or other means to allow you to access certain areas of the Website and/or to maintain your account security. It is your responsibility to maintain the confidentiality of your password and account information. Cocoon&me shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. Should you become aware of or suspect any unauthorised use of your password or account, please contact us. If Cocoon&me is suspicious of any fraudulent activity coming from your account, it can reserve the right to refuse you access to your account and can delete the account.
When you order through the Website via our guest checkout you will still need to provide us with certain compulsory personal information in order for us to process your order. We will not store the details that you provide via guest checkout (save for processing your order, or if you have opted in to receive marketing from us).
20. Workshop Refund Policy
Workshop Cancellations and alterations by us
In exceptional circumstances, we may have to cancel a workshop. If this does occur, we will give you as much notice as possible and will accommodate you on an alternative date. Failing this we will offer you an alternative product, or refund your booking fee. Unfortunately, we cannot accept any liability for travel or other costs.
Whilst we endeavour to provide workshops and in accordance with our promotional materials, we reserve the right to make variations and changes to some of the content from time to time.
Workshop Cancellations by customers
Cancellation by you with prior notice of 2 working days or less from the booking date will mean that the workshop will still be charged at the full fee.
Cancellations by you with prior notice of 2 working days or more from the course date will mean that the booking will be transferred to another workshop (subject to availability), but no refund will be offered in this instance. We try always to be understanding in these circumstances.
Cancellations by you with prior notice of more than 14 working days from the workshop date will mean that you will be transferred to another workshop (subject to availability) or fully refunded the fee you paid.
Please note working days are Monday to Friday.
Private Workshops/Parties
To confirm when booking a Workshop/Party the deposit of 50% must be paid when the date has been agreed by both parties.
Full payment is due 6 weeks before the Workshop date or if you wish to cancel 6 weeks prior to the Workshop/Party your deposit will be refunded.
If you wish to cancel after this point, then we will offer you an alternative, but we will be unable to refund the Workshop.
